ooooh

Terms of use

Last updated

ooooh is an iPhone app for thinking out loud. You talk, it listens, now and then it asks one short question, and at the end it writes notes. These terms cover the app and the service behind it. Using the app means you accept them.

The service

The app runs on your iPhone and transcribes on the device. The questions and the notes come from third-party models reached through a server I run, so those parts need a network connection and may be unavailable when a provider is down. I may change or stop the service. If I stop it, your notes stay on your phone and in your iCloud.

Acceptable use

Use the app for your own thinking. Don't use it to break the law, to harm someone, or to record people who haven't agreed to it. Don't probe or overload the server, try to extract its keys, or send it traffic from anything other than the app. I may block a device that does.

Your thinking, not advice

What you say is yours, and the notes are a record of your own thinking. The questions the app asks are prompts to keep you going. They are not advice. The app knows nothing about your situation beyond what you said in the session, so don't treat anything it says as legal, medical, financial, or professional advice. Models make mistakes. Read the notes before you act on them.

Subscriptions and refunds

Three sessions a month are free. The subscription costs $6.99 a month or $49.99 a year and is sold through the App Store. Apple handles billing, renewal, cancellation, and refunds under Apple's terms. Cancel from your Apple account settings. I can't issue refunds myself.

No warranty

The app is provided as it is. I don't promise it will always work, that it will notice every moment worth a question, or that the notes will be complete or correct. I'm one person and this is a small app.

Limitation of liability

To the extent the law allows, I'm not liable for any loss that comes from using the app or from being unable to use it, including lost data, lost time, or decisions made on the basis of the notes. If a court finds me liable anyway, my liability is capped at what you paid for the app in the twelve months before the claim.

Governing law

These terms are governed by the laws of the State of California, United States. Any dispute belongs to the state or federal courts in California.

Changes

I may update these terms. The date at the top changes when I do. Using the app after a change means you accept the new terms.
